By using our website or proceeding with an Engagement, you confirm that you have read and agree to these Terms and Conditions. If you are acting on behalf of a family group, you confirm that you have authority to bind that group to this Agreement.

Our Services are available to individuals aged 18 and over. By engaging our Services, you confirm that you meet this requirement. If you are under 18, you must not submit the enquiry form or enter into an Engagement.

3. Nature and Scope of Services

Vellumkin provides clerical records organisation and educational briefings for individuals and families managing inheritance papers and family archive collections. Our Services consist entirely of:

We do not provide legal advice, financial advice, estate planning advice, or any other form of professional counsel. We do not interpret the legal effect, validity or enforceability of any document. We do not contact any institution, authority or third party on a Client's behalf. Nothing in the Materials constitutes advice of any kind.

5. Intellectual Property

The website content, design, templates (including the Provenance Sheet Template and Boundaries Plate design), glossary format, and other original materials created by Vellumkin are our intellectual property and are protected under applicable Malaysian law.

The completed archive, register and other outputs produced from your documents belong to you. You may share, copy and use them freely. You may not reproduce or commercially distribute our template designs or format without our prior written consent.

6. Payment Terms

All fees are denominated in Malaysian Ringgit (RM). Current fees are:

Payment is due in full before or at the first appointment. We accept bank transfer (Interbank GIRO / DuitNow) and cash at our office. We do not accept payment by card at this time.

Refunds: If you cancel an Engagement at least 72 hours before the first appointment, we will refund the fee in full. Cancellations within 72 hours of the first appointment are non-refundable. Once an appointment has taken place, that portion of the fee is non-refundable. We may exercise discretion in exceptional circumstances.

7. Service Delivery and Scope Changes

The scope of each Engagement is set out in the written scope agreement signed at the outset. Changes to scope — for example, adding a significantly larger volume of documents than initially discussed — may require a revised fee, which we will discuss with you before proceeding.

Appointment dates and times are confirmed by mutual agreement. If we need to reschedule, we will give at least 48 hours' notice and offer an alternative date within a reasonable period.

8. Disclaimers

Our Services are provided as a clerical and educational resource. The Materials we produce reflect what was presented to us and do not constitute a legal, financial, professional or governmental assessment of any kind.

We make reasonable efforts to produce accurate and consistent outputs, but we do not warrant that the Materials are free from errors. Any error drawn to our attention within 14 days of delivery will be corrected at no additional charge.

We do not warrant that engaging our Services will produce any particular outcome in legal, estate, or administrative proceedings. Outcomes depend on factors outside our control and outside our scope of work.

9. Limitation of Liability

To the extent permitted by Malaysian law, our total liability to you in connection with any Engagement is limited to the fee paid for that Engagement.

We are not liable for any indirect, consequential, special or incidental loss arising from the use of our Services or Materials, including loss arising from reliance on Materials in legal, financial or estate proceedings.

We are not liable for delays caused by circumstances outside our reasonable control (including natural events, public health restrictions, or utility failures).

10. Indemnification

You agree to indemnify Vellumkin against any claim, loss or expense (including reasonable legal costs) arising from your breach of this Agreement, your misrepresentation of any document or your unlawful use of our Services or Materials.

11. Termination

Either party may terminate an Engagement by written notice. If you terminate after work has commenced, fees for appointments already completed are non-refundable. If we terminate due to your breach of this Agreement, we will not refund fees for work already undertaken.

Sections 8, 9, 10, 12 and 13 survive termination.

12. Dispute Resolution and Governing Law

These Terms and Conditions are governed by the laws of Malaysia. Any dispute arising from them will be subject to the non-exclusive jurisdiction of the courts of Malaysia.

Before commencing formal proceedings, the parties agree to attempt informal resolution by written communication. If a dispute is not resolved within 30 days of written notice, either party may pursue the matter through the courts or other available dispute resolution mechanisms under Malaysian law, including mediation through the Malaysian Mediation Centre.

14. Changes to These Terms

We may update these Terms and Conditions from time to time. Updated terms will be published on this page with a revised Last Updated date. Changes do not affect Engagements already in progress unless required by law. For new Engagements, the terms in force at the time of the scope agreement apply.
